RETURN POLICY

SMALL NOTE

I am a tiny artisanal reality. By now, thanks to large online retailers, we are used to buying everything we might like and then sending back the rest. It's convenient, but I am not a large retailer.
Such an attitude would damage my business because the vast majority of pieces I make at the time of order: therefore, I have to be careful with timing, quantities, materials, and stock.
I will always honor my return policy, but I invite you to think about it before purchasing.
Because if everyone did so, Malena Jewelry could no longer exist, while I would like to work for many more years.

You have the right to withdraw from the contract, without giving any reasons, within 14 days.

from the day you or a third party, other than the carrier and designated by you, acquires physical possession of the last good.

 

To exercise the right of withdrawal, you are required to inform me of your decision to withdraw from this contract through an explicit declaration via email:

To exercise the right of withdrawal:

• The jewelry must not have been used or damaged and must be in perfect condition.

• The jewelry must be returned with its original packaging and with the invoice/receipt.

• According to article 59 of the Consumer Code, products cannot be returned if made to measure or personalized in any way (for example: with engravings).

 

All marketed products enjoy the legal guarantee of conformity provided by articles 128 and following of the Consumer Code which covers any defects of conformity of the purchased items, existing at the time of delivery and which appear within 2 years from the delivery itself. Defects or damage caused by accidental events or by the Customer's responsibility for use of the products not in accordance with their intended use or as a result of normal wear and tear are excluded from defects of conformity and, therefore, from the legal guarantee. To benefit from this guarantee, the Customer must report the defect of conformity with a communication addressed to the seller indicating the defects and faults found. The Customer can ask, at their choice, the seller to repair the item or to replace it, without expenses in both cases, unless the requested remedy is impossible or imposes disproportionate costs on the seller. If repair or replacement is not possible, the Customer can opt for a proportional reduction of the price paid or for the termination of the contract. It is specified that the Customer does not have the right to terminate the contract if the defect of conformity is only of minor importance.
 

Refunds
If, by agreement, it is recognized that the product was defective and cannot be resolved except with a refund, I will offer such a refund to be credited to a credit card or a PayPal account, depending on the method used at the time of payment.
Shipping costs will not be included in the refund.
I recommend using a trusted courier to send back the jewelry. I cannot be held responsible for unsuccessful delivery of returns.
After receiving the returns and checking compliance with the mentioned conditions, I will contact you and we will begin the refund procedure.

 

Updates to PayPal Terms of Use - A3.4 Refunds on commercial transactions - Effective date: March 5, 2020
Starting from March 5, 2020, if the buyer who makes a purchase on the site selects the payment method with the PayPal system, where subsequently the same buyer requests a refund for any reason and for any reason of the amount paid, this refund will not include the fees withheld by PayPal (equal to a fixed sum of 0.35 euros + a variable sum equal to 3.4% of the amount paid), but only the net of the transaction. Furthermore, from this net, any fees related to transport, cash on delivery, etc. may also be further deducted for any reason and in any form, thus proceeding to refund only the resulting net.

The cost of the repair is borne by the buyer and includes:

• The reimbursement of expenses for the maintenance of the galvanic bath.

• The cost of any materials used for the repair of the item.
